The point that he missed is this: torture is a crime under both international and US law, and the USA government is legally obligated to prosecute it.  Since it is openly admitted by Cheney that he, Bush, and their minions committed this long series of crimes, the US government is legally required to prosecute them. That Obama "rules out" prosecution for torturers, even for one of them, makes him an accomplice after the fact, a high crime demanding impeachment on several counts--the least disputable being nonfeasance of the affirmative duty of the office of president to enforce the law.
