You are looking at it too philosophically and/or legally when you call
it "moronic." I think they ('they' -whoever) know what they are doing,
and you illustrate their aims in noting that the ACLU has other things
to do.... And of course it is not just in the last few years that police
have made blatantly illegal arrests. Often all that is needed for their
purposes is to hold people overnight or impose a financial cost on them
or just put up a warning that a demo might be dangerous. Etc. etc. That
is one of the differences between fascist repression and
bourgeois-democratic repression. And in this respect your pointing out
that there is no reason to rejoice is important, and this touches on my
reason for disliking the overuse of the charge of fascism. It blinds
people's eyes (as when they rejoice at a court victory) to the way
repression in the U.S. actually operates (in contrast to the way it
operates in either real or imaginary fascisms).
