someone's got to argue that there are two types of marriage:

1) civil marriages (or civil unions), where the rights and responsibilities are determined by the state.

2) religious marriages, where the rights and responsibilities are determined by the religion. 

It seems to me that the state can't ban gay marriages of the first kind, but a religion can ban gay marriages (of the 2nd kind). Those religions that want to discriminate on the basis of sexuality would be allowed to do so. Of course, I'd avoid them even more than I do already.

The basic principle is that of the division between church and state. Render unto Caesar and all that...
