Yes, but that is a problem of whether the public power should recognize
the activity as liberty, not whether the people can understand that
what you are doing could be construed as liberty.
For example, ordinary folks understand that smoking dope is arguably a
function of liberty. Ordinary folks honestly disagree, though, on
whether it should be a function of liberty.
