I think Cde Hartal was making an empirical statement here, rather than
expressing a value-judgement of his own. He seems to think that the
American people (by and large) do not value their constitutional
liberty highly enough to be reluctant to forgo it when it is suggested
to these people that the price of insisting upon such liberties would
be that they would be menaced by terror.
This is a claim of an empirical nature, and can be validated or
falsified only by empirical means. Cde Hartal's mistake here seems to
be that he provided no evidence for this claim, i.e. that he made an
unsubstantiated claim.
