It's murder at any rate.

The US did not try to get him "dead or alive", but they wanted to get
him dead.

Otherwise they would have tried to capture him in that house where he
was supposedly tracked down by "intelligence", and only sent in the air
force, when a battle would have emerged, and they would see not other
way to defeat the resistance of the occupants of that house than by
bombarding the house.

They call him a "criminal", but the common idea about the prosecution
of criminals is that one tries to capture the criminal and put him on
trial, and hand down any sentence which is appropriate for his crimes on
the books of the given country holding the trial.

And have not all police forces and armies of the world developed the
technique of surprise attacks designed to capture people alive? As the
INS so well demonstrated in their attack on the house where the little
Cuban boy Elián was held by distant relatives.

No, placing the two bombs on the house was the first means, and it
was obviously designed to kill Zarqawi, not to disable defenses.

So it would not be surprising at all, if they then killed the
defenseless Zarqawi after he survived the bomb blasts.

AFter the experiences with the trials against Saddam Hussein and
against Milosevic, they obviously had no interest in capturing Zarqawi
alive and let him speak before the public of a court, followed by the
world media.

It has also to be noted that "success" of killing Zarkawi came very
timely when the credibility of the US occupation was shattered by the
Haditha and other massacres. I read an article which speculates that
Zarqawi was dead for a long time, and that this incident was manipulated
just to draw attention away from Haditha, but I think that this goes to
far in conspiracy speculations.
