Employers must pay overtime: labour board

WINNIPEG - The Manitoba Labour Board has ruled in favour of a Winnipeg woman 
who complained clothing giant Nygard International forced her to work overtime 
without paying her for it.

The board ruled Nygard International must pay former employee Sharon 
Michalowski more than $10,000 in overtime and vacation pay.

Michalowski, a sales supervisor, signed a manager's "all-inclusive" contract 
with Nygard, meaning she had to work all the hours required by the company 
without overtime pay.
The single mother says she was prepared to work overtime ? but not as many 
hours as she did. She left the company in 2003.

The Manitoba Labour Board ruled that making employees work overtime without 
compensation is against the law, even for supervisors. The ruling upholds a 
decision from the province's employment standards division.

Michalowski is delighted with the board's ruling. "This isn't just about me. 
It's about a lot of employees that have been taken advantage of," she says. 
"Now with this ruling, people will be able to go back and reclaim some of the 
money that was taken from them."

A Nygard International spokesperson says the company will appeal the decision. 
The company warns the ruling may set a dangerous precedent that will discourage 
employment growth in Manitoba.
