Draft Blackfoot Constitution Part X



Article 64
The Representatives, in consultation with and with the approval of the
Principal Chief and Advisors, and with the active participation and consent
of the majority of the Blackfoot Nation, shall be responsible for, but not
limited to the following imperatives for the survival and prosperity of the
Blackfoot Nation: a) Proposing and Ratifying Treaties With Foreign Nations
including First Nations; b) Regulating Commerce With Other Nations; c)
Establishing Uniform Rules of Naturalization; d) Establishing Standards of
Weights and Measures; e) Establishing Currency and Protecting the Integrity,
Exchangeability and Value of the Currency; f) Punishing Counterfeiting of
Currency; g) Establishing, Planning and Maintaining Post Offices, Roads,
Sewage, Water Supplies and all Infrastructure Necessary for the Survival and
Prosperity of the Blackfoot Nation; h) Establishing and Staffing the Supreme
and Lesser Courts of the Blackfoot Nation; i) Raising and Financing Military
Forces; j) Suppressing Insurrections and Repelling Invasions; k) Contacts,
Diplomatic Exchanges and Alliances With Foreign Nations and International
Organizations; k) Protecting and Enhancing Social Cohesion Among Constituent
Elements of the Blackfoot Nation; l) Decentralizing and Delegating Certain
Responsibilities and Duties to Citizenry; m) Initiating, Convening and
Implementing Impeachment Procedures and Decisions; n) Promoting Respect for
and Authority of International Law; o) Declarations and Conduct of War; p)
Provision of Public Goods; q) Balancing Contending Interests and
Ameliorating Inequalities Threatening the Survival and Prosperity of the
Blackfoot Nation; r) Raising Revenues and Making Expenditures Consistent
With Policies, Needs and the Constitution; s) Maintaining the Independence,
Sovereignty, Prosperity and Self-determination of the Blackfoot Nation; t)
Regulating Activities and Rights of Non-Blackfoot Citizens Resident on
Blackfoot Lands and/or Encroaching on Blackfoot Lands; u) Initiating,
Implementing and Ensuring Compliance With Laws and Acts Designed to Protect
the Culture, Values, Morals and Traditions of the Blackfoot Nation; v)
Protection and Nurturing of Vulnerable and Incapacitated Blackfoot Citizens;
w) Declaration of National Emergencies and Raising/Allocating Resources to
Deal With Them; x) Enacting and Evolving Criminal and Civil Mandates, Laws,
Penalties and Procedures; y) Ensuring Equal Protection of and Access to Law
for All Citizens; z) Conducting Intelligence Related to and
Raising/Deploying Resources Against Potential Threats to National Security .

CHAPTER V
LAW AND JUDICIARY

Article 65
In accordance with Blackfoot Law and traditions, the supposed "duality" or
differentiation between criminal and tort or civil law is rejected as
dangerous to the survival and prosperity of the Blackfoot Nation. All
crimes necessarily generate torts and many torts are crimes when seen in
their totality of humanity and real causes and effects.

Article 66
The fundamental mandates guiding all law and judicial processes shall be:
Truth; Justice; Healing; Reconciliation; Prevention of Future Abuses;
Survival and Prosperity of the Blackfoot Nation. All rights, policies,
judicial procedures, protocols and regulations governing individuals,
judicial processes and government are without prejudice to and subordinate
to these survival imperatives and mandates.

Article 67
Judges of the Blackfoot Supreme Court and lower courts shall be appointed by
the Principal Chief and Advisors with the consent of two-thirds of the
Representatives. No person not trained in Blackfoot traditions and law may
serve as a Judge and Judges shall serve terms of appointment to be
determined by the competent authorities of the Blackfoot.

Article 68
Judges may be removed for cause upon the recommendation of the Principal
Chief and Advisors and ratified by two-thirds of the Representatives voting.
Any impeachable offense, corruption or provable prejudice and compromise or
conflict-of-interest in conducting judicial proceedings or rendering
judicial decisions may be grounds for removal of judges.
