The following analysis is not written from the point of view of Marxism, but
from the ordinary point of view of someone who has read a lot of federal
court opinions. This is the STUPIDEST complaint that I have ever read
(considering that it was written by "respected lawyers"). It has NO
foundation. It asks the federal courts to strike down Florida's election
laws (which permit the recount) on the basis of nothing but a political
speech. There is no showing of federally cognizable injury. There is no
citation to any caselaw. It's a joke. It is not as well-researched or
soundly based as the complaint I wrote in 1981 demanding that the Illinois
Commerce Commission prevent winter heat shutoffs. It cannot possibly be
granted unless elements of the ruling class are exerting direct
behind-the-scenes influence.
BTW, the judge is a Clinton appointee.
